This proposal would authorize trial courts to establish pilot projects permitting remote video trials in cases involving traffic infraction violations and violations of the law on compulsory school attendance. The proposed rules, forms, and legislation will enable courts to provide the public with continuing access to court proceedings at a time when court resources are being substantially reduced. If a court establishes a remote video proceeding pilot project, defendants in eligible cases would be able to elect to appear at trial by two-way video from remote locations designated by the court. The suggestion for remote video trial pilot projects originates from the Superior Court of Fresno County, which has recently been compelled to close several court facilities because of budget reductions.

This proposal would amend the rules for the judicial arbitration program to: (1) provide that an arbitrator can request compensation if the arbitrator devoted a substantial amount of time to a case that was settled without filing of an award; and (2) clarify that, in order to prevent entry of a judicial arbitration award as the judgment in a case, any request to dismiss the entire case must be signed by all parties to the case and any request to dismiss all parties to the arbitration must be signed by all those parties.

This proposal would amend the rules to be consistent and require that attorneys and selfrepresented parties in both trial and appellate courts initially provide the same contact information, including e-mail addresses if available, and provide that changes in this information, including e-mail addresses, trigger a requirement that they notify the court and other parties. This proposal would also clarify that if multiple attorneys from the same law firm, corporation, or public law office are joining in a document filed in the Court of Appeal, the cover of the document must include the names and State Bar numbers for all of the attorneys, but the law firm, corporation, or public law office must designate only one attorney to receive notices and other communications from the court. This proposal originated from suggestions submitted by a Clerk of the Court of Appeal and by the California Appellate Court Clerks Association.

This is a proposal to amend rule 3.670 of the California Rules of Court on telephone appearances. The proposed amendment would increase the fee to appear by telephone in civil cases from $78 to $86, effective July 1, 2013, and would make other changes to clarify the operation of the fee provisions in the rule. The changes in the rule are needed at this time to respond to recent legislation and to provide for the amendment of the statewide master agreement for telephone appearance services, which is set to end on June 30, 2013. The proposal is recommended by the Administrative Office of the Courts.

SB 1186 was enacted on September 19, 2012, to promote compliance with the state's disability access laws and deter unwarranted litigation in that area. The new statute revises the notice that attorneys are required to send out with any demand letter or complaint concerning construction-related accessibility violations of the Unruh Civil Rights Act, and creates a new alternative mandatory evaluation conference option for parties in actions on such claims. The new law mandates that the council revise the existing attorney advisory form and develop new forms for parties to apply for and courts to give notice of the new mandatory evaluation conferences. This proposal also includes rules for service of the notices for the current and new evaluation conferences.

The Judicial Council has adopted forms, effective January 1, 2013, for defendants to apply for and the court to give notice of a stay of proceedings and early evaluation conference in construction-related accessibility claims. Senate Bill 1186 (Steinberg and Dutton; Stats. 2012, ch. 383) was enacted in late September 2012 to promote compliance with the state’s disability access laws and deter unwarranted litigation in that area. Many provisions of the new law are already in effect, including the expansion of the categories of defendants who are eligible for automatic stays and early evaluation conferences under Civil Code section 55.54. The new law mandates that the Judicial Council revise the current provisional and statutorily mandated forms to implement these changes by January 1, 2013. Because of the short time between the enactment of the new law and the mandated effective date for these forms, the Civil and Small Claims Advisory Committee recommended, and the council agreed, that the forms should be adopted prior to circulation for public comment. The forms are now being circulated and the advisory committee will return to the council with any further recommendations based on comments received.

AB 2364 amends the statutory requirements as to what statements must be included in the memorandum of a garnishee served in response to a writ of attachment or a writ of execution. Judicial Council form AT-167/EJ-152 will be inconsistent with current law if it is not revised. Because the form must be revised to comply with the new law, the Civil and Small Claims Advisory Committee is recommending that at the same time, the formatting of the caption and file-stamp boxes on the form should be revised to be comparable with the current format for Judicial Council forms that are not recorded, and items added to include the names of the garnishee and the judgment debtor.

If a settlement agreement conditions the dismissal of a case on the satisfactory completion of specified terms that are not to be performed within 45 days of the settlement, rule 3.1385 requires that a notice of conditional settlement specify the date by which the dismissal is to be filed. The proposed amendment would provide that hearings and other proceedings requiring the appearance of a party be vacated during the time between the filing of the notice of conditional settlement and the specified dismissal date. The Civil and Small Claims Advisory Committee’s Collections Cases Working Group, which is made up of advisory committee members and outside consultants, proposed this rule amendment. Attorney members of the working group reported that because court proceedings requiring the appearance of parties are not vacated, they often have to make unnecessary appearances after a case has been settled but before all installment payments have been made and before a request for dismissal has been filed.

The Civil and Small Claims Advisory Committee recommends new Form Interrogatories—Construction Litigation, which includes interrogatories on topics specific to construction litigation as well as several topics from the general civil form interrogatories, some of which have been revised to more specifically address construction cases. Form interrogatories exist for general use in civil cases and for certain specialized types of cases, but there are currently none specifically for use in construction litigation. Practitioners in the area of construction litigation have urged adoption of form interrogatories for several years, with the goals of eliminating the need for parties to craft special interrogatories for the most commonly asked questions, standardizing those questions so that parties will be aware of what information will have to be provided in the action and, as a result, decreasing the number of motions to compel filed in the courts.

The Family and Juvenile Law Advisory Committee proposes one rule and one form for adoption by the Judicial Council that clarify the requirements for courts conducting adoptions under the Hague Adoption Convention, and proposes revisions to two Judicial Council forms for use in adoption proceedings. Changes to the affected forms are also needed to conform to new legislation: AB 687, which allows the court to issue orders of adoption nunc pro tunc in certain cases; and AB 1757, which amends and adds sections to the Family Code that affect adoptions. The committee also intends to include language mandated by AB 792 in the adoption request (form ADOPT-200) as soon as the language has been determined. Other proposed changes respond to many suggestions the Administrative Office of the Courts and the Judicial Council have received from courts and other users to make the forms both easier to use and more comprehensive.
Juvenile Law: Indian Child Welfare Act in Delinquency Cases (PDF, 147 KB)

The California Supreme Court’s decision in In re W.B. 55 Cal.4th 30, issued August 6, 2012, requires revisions to the California Rules of Court governing the application of the Indian Child Welfare Act (ICWA) and corresponding provisions of the Welfare and Institutions Code in juvenile wardship proceedings. As currently written, the rules require compliance with all of the substantive ICWA requirements in any juvenile wardship proceeding when the child is in foster care or at risk of entering foster care. The California Supreme Court held in W.B. that this application of ICWA and state law is overbroad.
Family Law: Revision to Declaration of Disclosure Forms (PDF, 308 KB)

In a proceeding for dissolution, nullity, or legal separation of a marriage or domestic partnership, Family Code section 2104 requires each party to serve on the other documents comprising a preliminary declaration of disclosure of assets and obligations. Effective January 1, 2013, AB 1406 amends section 2104 by establishing a timeline for service of the preliminary disclosure documents and requiring that a preliminary declaration of disclosure include all tax returns filed by the party within a specified period of time. These statutory changes affect two mandatory Judicial Council forms FL-140 and FL-141, and one information sheet, form FL-107-INFO. The committee further proposes revising form FL-160 to permit its use to comply with other disclosure requirements and streamline the process in family law default proceedings.
Family Law: Amend Forms for Dissolution of Domestic Partnership or Marriage to Correct Substantive Omissions and Other Issues (PDF, 140 KB)

Juvenile Law: Interstate Compact on the Placement of Children (PDF, 207 KB)

The interstate agreement known as the Interstate Compact on the Placement of Children or ICPC governs the placement of California children in other states, as well as the placement of out-of-state children in California. Although the Interstate Compact on the Placement of Children has not changed in recent years, the regulations implementing the ICPC were amended in 2010 and again in 2011. Most notably, Regulation No. 7, regarding expedited out-of-state placements of dependent children, was significantly expanded and revised in 2011. In addition, a 2010 Court of Appeal opinion invalidated rule 5.616(b)(1) of the California Rules of Court, which concerns placement of a child out of state in the home of a parent. These developments require that rule 5.616 and two ICPC-related forms be revised to bring them in line with the new requirements.
Juvenile Law: Access to Services (PDF, 328 KB)

The proposal would make rules and forms consistent with recent legislation intended to improve access to educational and developmental services for juvenile dependents and wards. Specifically, the new requirements of Senate Bill 368 on the limitation of parental authority to make decisions concerning dependent children’s developmental services; the extension in Assembly Bill 1933 of a child’s right to remain in his or her school of origin to “the duration of the jurisdiction of the court”; and the requirements in AB 791 that the juvenile court, whenever it denies or terminates reunification services, order that the agency provide the child's birth certificate to the caregiver and, if the child is over 16, to the child. Finally, rule 5.790 would be amended to include a provision that requires the court to make findings regarding the probation department’s family-finding investigation required by Welfare and Institutions Code section 628(d), which was added by AB 938 in 2009.
Juvenile Dependency: Counsel Collections Program (PDF, 3579 KB)

Recent legislation requires the Judicial Council to establish a program to collect the cost of dependency-related legal services from responsible persons who are able to bear that cost. Specifically, section 903.47 of the Welfare and Institutions Code, as added in 2009 by Assembly Bill 131, and amended by Assembly Bill 1229 and Senate Bill 647, requires the Judicial Council to “establish a program to collect reimbursements from the person liable for the costs of counsel appointed to represent parents or minors” under section 903.1 in dependency proceedings. The statute further mandates that the program include a statewide standard for determining a responsible person’s ability to pay reimbursement as well as policies and procedures allowing a court to recover its costs associated with implementing the program. The guidelines are intended to give each court the greatest possible flexibility, within the limits imposed by statute, to implement the program in the most cost-effective manner and to tailor the program to local needs and circumstances.

Proposed Legislation: Modernization and Improvement of Statutes on Trial Court Records Retention and Management (PDF, 141 KB)

The Court Executives Advisory Committee recommends that the Judicial Council sponsor legislation to modernize and improve the statutes concerning the retention of trial court records and to realize financial savings. Specifically, this proposal recommends that the records retention statutes be amended to authorize the destruction of various court records earlier than is permitted under existing law; this will enable the trial courts to reduce their storage costs. The amendments will also establish statutory records retention periods for new types of records that are not dealt with under existing law—such as records resulting from the new criminal realignment process. The proposed amendments will eliminate gaps and ambiguities in the law relating to records retention; this will clarify for how long certain records are to be retained. This proposal will also amend the trial court records statutes to clarify that the clerk of the court may use technology to generate certified copies of court records. Finally, the amendments will result in Government Code section 68152, the main records retention statute, being organized in a more logical, readable and understandable manner.
Criminal Justice Realignment: Supervision Revocation Procedure (PDF, 104 KB)

Following the October 1, 2011, implementation of criminal justice realignment, courts are required to conduct supervision revocation proceedings for three categories of supervision—probation, mandatory supervision, and postrelease community supervision, each with distinct procedural requirements. A fourth category—revocation of state parole—becomes effective July 1, 2013. To reduce confusion and promote consistency across the four types of significantly similar proceedings, this proposal would amend various statutes to apply probation revocation procedures under Penal Code section 1203.2 to all four categories of supervision.

In response to a direction from the Legislature, the Probate and Mental Health Advisory Committee proposes that the Judicial Council adopt guidelines for determining the financial eligibility for payment by the county of all or a portion of the cost of counsel appointed for (proposed) conservatees and wards and for certain other persons, in proceedings under the Guardianship-Conservatorship Law. The advisory committee also proposes the amendment of rule 1.4(d) of the California Rules of Court to specify that the guidelines will be included in the rules as Appendix E.

The proposal would implement a new statutory requirement regarding a court in which a petition for the appointment of a guardian of the person of a minor has been filed. Such a court must communicate with courts in all other California counties where family law custody or visitation proceedings concerning the minor were previously filed before determining the appropriate venue for the guardianship proceeding. The proposed rule is a response to a provision in the new law that directs the Judicial Council to adopt rules of court to implement the intercourt communication mandate of the law by January 1, 2013.

The proposal would extend to probate guardianship proceedings provisions of recently effective legislation and parts of a recently adopted rule of court pertaining to the testimony of children involved in custody and visitation litigation under the Family Code. The Probate and Mental Health Advisory Committee proposes a probate rule of court on this topic because the Family Code section that compelled the adoption of the new family law rule of court applies also to the appointment of a guardian of the person of a child. The advisory committee recommends the adoption of a separate rule concerning the receipt of information from (proposed) wards in guardianship proceedings rather than the direct application of the family law rule to those proceedings because of differences between the two types of cases.

Certain advice given in two Judicial Council forms to creditors of a decedent concerning the time they have to file claims with the court and the personal representative of the decedent’s estate is inaccurate and potentially misleading in some situations. This advice is mandated by statute. Legislation sponsored by the Judicial Council is anticipated in 2012 to amend the statute to require the forms to provide more accurate advice. If that legislation becomes law effective on January 1, 2013, the forms must be revised to conform to the amended statute. The forms also fail to alert creditors that law other than that governing the creditors’ claim process may affect their claims. The Probate and Mental Health Advisory Committee proposes to revise the forms effective on the same date as the legislation to address these defects.

The Strategic Evaluation Committee (SEC) was appointed by Chief Justice Tani G. Cantil-Sakauye in March 2011 to conduct an in-depth review of the AOC with a view toward promoting transparency, accountability, and efficiency.The Chief Justice received the report and recommendations on May 25. At its meeting on June 21, 2012, the Judicial Council accepted the report and directed that it be posted for public comment for 30 days. Comments received will be considered public and posted by name and organization under the Comments Received link below. The Judicial Council is the policy-making body for the judicial branch. References to specific cases, and judges, attorneys, parties, and others involved in a specific case may be redacted from posted comments on the SEC report.

This draft opinion addresses two questions: (1) May a judge invite partners of law firms in the county to attend a meeting at which the judge makes a presentation concerning potential budget cuts and asks that the attorneys to help the court in whatever way they believe is appropriate?; and (2) May a judge at the same meeting ask attorneys to write or meet with legislators in Sacramento on the court’s behalf? The draft opinion analyzes the applicable canons and provides guidance on proper judicial conduct under circumstances related to these questions.

On December 14, 2012, the Judicial Council adopted revised forms TR-115 and TR-INST, effective January 1, 2013. Vehicle Code section 40518(a) authorizes the Judicial Council to prescribe the form of a notice to appear that is issued when a person is cited by an automated enforcement system for certain red light violations. Recent legislation, enacted effective January 1, 2013, amended Vehicle Code section 40518 to require specific additional contact information for the notice to appear form and amended Vehicle Code section 42005 to permit drivers with a commercial driver's license who are cited for a violation while driving a noncommercial vehicle to attend traffic violator school (TVS). Because the revised forms were adopted to comply with the new law without an opportunity for public comment, this invitation seeks comment about any further changes to the forms that may be needed.

Vehicle Code section 40500(b) authorizes the Judicial Council to prescribe the form of a notice to appear that is issued when a person is arrested for misdemeanor or infraction violations of the Vehicle Code. Penal Code section 853.9 further authorizes the council to approve notice to appear forms for nontraffic offenses. Penal Code section 959.1(d) permits a notice to appear issued on a form approved by the Judicial Council to be received and filed by a court in electronic form. In response to issues courts have reported with electronic citation forms and procedures and to improve uniformity of the content of notice to appear forms used for electronic citations issued by arresting officers, the Traffic Advisory Committee recommends the amendment of rule 4.103 of the California Rules of Court, the adoption of form TR-135, and the revision of form TR-INST, to become effective July 1, 2013.
