The proposals on this page have circulated for comment. Most of them were subsequently submitted to the Judicial Council for action. To see how the Judicial Council acted on a proposal, please visit the council’s meeting page, where meeting materials and minutes are available.

In general, if a proposal has a suggested January 1 effective date, it would most likely be on the council’s October agenda; if it has a July 1 effective date, it would most likely be on the April agenda.

Senate Bill 501 (Wieckowski, 2015) (SB 501) amends the method of computing the amount of a judgment debtor’s earnings that may be garnished under an earnings withholding order, effective July 1, 2016.  Two mandatory Judicial Council forms, Earnings Withholding Order (Wage Garnishment) (form WG-002) and Earnings Withholding Order for Elder or Dependent Adult Financial Abuse (form WG-030), include instructions to employers describing the maximum amounts that may be garnished, which must be revised to reflect the new law.

Assembly Bill 555 (Alejo; Stats. 2015, ch. 330) lifts the sunset provisions in the Expedited Jury Trial Act, which went into effect on January 1, 2011, to establish an expedited jury trial process—a consensual process designed to promote the speedy and economic resolution of cases and to conserve judicial resources. The bill also amends the time frame applicable to such trials from three hours per side to five hours per side, and significantly expands the statute to require expedited jury trials in most limited civil actions other than unlawful detainers. This proposal amends and revises the rules and forms applicable to the current voluntary expedited jury trials to reflect the amendments to the time frame, and includes new rules and forms for the mandatory expedited jury trials in limited civil cases. The statute mandates that the new and amended rules and forms be operative by July 1, 2016.

The Civil and Small Claims Advisory Committee recommends that certain statutorily mandated Disability Access Litigation forms used in construction-related accessibility claims be revised and that a verified answer form be approved for optional use. The forms are used for parties to apply for and the court to grant stays and mandatory evaluation conferences in this type of litigation. The forms must be changed to reflect the amendments to the Civil Code made by Assembly Bill 1521 (Assembly Judiciary Committee; Stats. 2015, ch.755), enacted in October 10, 2015 as urgency legislation (and thus operative on enactment) to (1) add a new category of defendants that may request a stay and early evaluation conference, (2) allow defendants to request a joint inspection, (3) provide certain information in the statutory advisory form for building owners and tenants, and (3) provide a verified answer form.

In 2013, the Judicial Council amended the statewide rules of court on civil case management to give courts the discretion to exempt certain types or categories of general civil cases from the mandatory case management rules. The amendments were an emergency measure, intended to help courts to better address the state’s fiscal crisis by decreasing the time spent by court staff and judicial officers in filing case management statements, setting and holding individual case management conferences, and performing other actions required by the case management rules. The exemption provided in the rule was intended to be temporary, and by the terms of the amended rule applies only to cases filed before January 1, 2016. The proposal would extend the exemption in light of the continuing fiscal crisis.

This proposal would correct two issues in a current optional Judicial Council form for providing proof of service in civil cases, regarding who can perform electronic service and when personal service may be accomplished by leaving a copy with an individual at an attorney’s office. This proposal originated from comments on the form received from several sources, including a legal publisher and two individual attorneys.

Recently, the Judicial Council adopted amendments to the telephonic appearances rule, rule 3.670. The primary impact of the rule changes was to include ex parte applications under the rubric of civil matters at which parties could, as a general rule, appear by telephone if appropriate notice was provided, and to shorten notice for all telephonic appearances from three days to two. This new proposal amends the rule to clarify certain of the service of notice provisions in light of the new two-day timeline and revises the Notice of Intent to Appear by Telephone (CIV-020) to correct the rule references and the time frame for notice.

The proposed new forms implement legislation effective January 1, 2016, found at Penal Code section 18100 et seq. The statutes provide a civil process to obtain a court order requiring a person to surrender, and prohibiting him or her from possessing, firearms and ammunition before the person uses a firearm to commit a crime. The Judicial Council is statutorily required to “prescribe the forms of the petitions and orders and any other documents required to implement the legislation.”

The Traffic Advisory Committee and Criminal Law Advisory Committee propose amendment of California Rules of Court, rule 4.105, regarding procedures related to deposit of bail for infraction offenses and adoption of rule 4.106, regarding procedures after failure to appear or pay for an infraction offense. Amendment of rule 4.105 is proposed to improve notice of court procedures by requiring the local website for trial courts to include a link to statewide self-help information posted on the California judicial branch website for traffic cases. Adoption of rule 4.106 is recommended to standardize and improve court procedures related to failure to appear or pay for infraction offenses. The proposed amended rule and new rule were developed in response to Judicial Council directives that the advisory committees continue to explore recommendations necessary to promote access to justice in all infraction cases.

The Civil and Small Claims Advisory Committee recommends that certain statutorily mandated Disability Access Litigation forms used in construction-related accessibility claims be revised and that a verified answer form be approved for optional use. The forms are used for parties to apply for and the court to grant stays and mandatory evaluation conferences in this type of litigation. The forms must be changed to reflect the amendments to the Civil Code made by Assembly Bill 1521 (Assembly Judiciary Committee; Stats. 2015, ch.755), enacted in October 10, 2015 as urgency legislation (and thus operative on enactment) to (1) add a new category of defendants that may request a stay and early evaluation conference, (2) allow defendants to request a joint inspection, (3) provide certain information in the statutory advisory form for building owners and tenants, and (3) provide a verified answer form.

The Family and Juvenile Law Advisory Committee recommends that the Judicial Council adopt four forms and revise five forms used in Domestic Violence Prevention Act (DVPA) cases to implement changes made by Assembly Bill 439, Assembly Bill 536, and Assembly Bill 1407. The committee also recommends including an additional advisement on the restraining order forms to notify the restrained party of the possible immigration consequences for violating a restraining order.

In recent years, the Family and Juvenile Law Advisory Committee has been developing two separate proposals in the areas of Domestic Violence (concerning the modification or termination of restraining orders) and Family Law (relating to Request for Order rules and forms). Although the impetus for each proposal originates from different sources, there is significant overlap in the forms that would be affected by the proposals. For example, each proposes several changes to Request for Order (form FL-300) and Responsive Declaration to Request for Order (form FL-320). The proposals are being circulated together as they concern a number of important overlapping issues for family law and domestic violence legal communities to consider.

Domestic Violence Law—Get Ready for the Restraining Order Court Hearing (PDF, 547 KB)

Form DV-520-INFO, Get Ready for the Court Hearing, is available for optional use by courts to provide information to litigants about preparing for a domestic violence restraining order hearing, hundreds of which are held each day in courts throughout the state. Courts report finding the form helpful; however, the current version includes information that can be confusing and, as a result, may cause unnecessary difficulties and delays at hearings. Rather than continuing to provide legally inaccurate information, some courts have chosen not to use the form and do not have a substitute readily available. Additionally, this form remains on the public website, so litigants may be relying on it to their detriment. The proposal would revise the form in so that it is clearer, is legally accurate, and as a result, accomplishes the original goal in adopting the form: to inform litigants and assist in making these complex and important hearings run more smoothly.

Bill 855) adding section 300(b)(2) to the Welfare and Institutions Code, to facilitate bringing Commercially Sexually Exploited Children (CSEC) into the juvenile dependency system. The committee is also proposing technical changes responding to the new section 300(b)(2) to form JV-101(A), Additional Children Attachment, which was inadvertently left out of the technical change cycle approved by the Judicial Council on October 27, 2015.

To implement Assembly Bill 879, the Family and Juvenile Law Advisory Committee and the Information Technology Advisory Committee jointly propose (1) amending rules 5.524, 5.534, and 5.708 of the California Rules of Court; (2) adopting mandatory form EFS-005-JV/JV-141, E-Mail Notice of Hearing: Consent, Withdrawal of Consent, Address Change (Juvenile); and (3) renumbering existing form EFS-005 as EFS-005-CV.  Effective January 1, 2016, AB 879 authorizes e-mailing notices of hearings in juvenile court under Welfare and Institutions Code sections 290.1–295. This proposal aligns notice provisions in the rules with this change in law and provides a form for obtaining consent to electronic notice of hearings from those persons entitled to notice of juvenile court hearings.  This proposal would also make technical changes to rules 5.550 and 5.815 to update references to and eliminate inconsistencies with the statutes.

The Family and Juvenile Law Advisory Committee recommends adopting a rule of court to guide litigants and courts in filing and adjudicating requests for Special Immigrant Juvenile (SIJ) findings in family law custody proceedings. The rule is needed for effective implementation of section 155 of the Code of Civil Procedure. (Sen. Bill 873; Stats. 2014, ch. 685, § 1.) Adoption of the rule would also respond to requests for a rule from the courts and the public in response to a previous invitation to comment.

To implement Assembly Bill 1519, the Family and Juvenile Law Advisory Committee and the Information Technology Advisory Committee recommend amending California Rules of Court, rule 2.257, which governs the use of signatures on electronically filed documents. Effective January 1, 2016, AB 1519 amends Family Code section 17400(b)(3) to provide that local child support agencies (1) are required to maintain original signed pleadings only for the time period stated in Government Code section 68152(a); and (2) may maintain original signed pleadings by way of an electronic copy in the statewide automated child support system. AB 1519 requires the Judicial Council to develop implementing rules by July 1, 2016.

This proposal would adopt amendments (Amendments) to the Judicial Council Conflict of Interest Code (Code) and align the Code with the Judicial Council’s new classification and compensation structure.  In accordance with Government Code Sections 87303 and 87306, the Code must be updated “when change is necessitated by changed circumstances, including the creation of new positions” (id., § 87306). The council must review proposed Amendments to the Code and approve the Code as amended or direct that it be further revised and resubmitted for approval.

Amendments to Government Code section 68106, which took effect on January 1, 2012, created new requirements for public notice and comment when trial courts decide to close court facilities or reduce hours. These requirements are inconsistent with the requirements of rule 10.620, and trial courts have faced confusion in determining how notice is to be provided. The proposal would amend the rule to repeal those provisions that are inconsistent with Gov. Code section 68106, leaving the statute as the sole governing authority regarding notice where it is applicable, and to make the language of the rule regarding posting of notice at court facilities consistent with section 68106.

Trial Courts: Permanent Authorization for Remote Video Proceedings in Traffic Infraction Cases (PDF, 198 KB)

Rule 4.220 authorizes trial courts to establish remote video pilot projects by local rule, subject to the approval of the Judicial Council, in cases involving traffic infraction violations. The rule only remains in effect until January 1, 2016, unless the council amends the rule. This proposal would remove the sunset language in rule 4.220 and convert the rule into a standing rule of court. The amendments would allow trial courts to conduct remote video proceedings (RVP) in eligible traffic cases after January 1, 2016, so long as the courts adopt a local rule permitting RVP, notify the council, and comply with a semiannual reporting requirement. Minor changes would also be made to form TR-500-INFO to eliminate references to the pilot project. This proposal originated from the Superior Court of Fresno County, which has successfully implemented a pilot project under the current rule.

The Court Executives Advisory Committee (CEAC) proposes amending the rule relating to the sampling of court records to substantially reduce the number of records that superior courts are required to keep, thus reducing court costs, while still ensuring that courts preserve a statistically significant sample of court records for future research purposes. The committee also proposes amending the statute regarding the destruction of court records to eliminate the requirement that superior courts must report destroyed court records to the Judicial Council. This burdensome requirement is unnecessary because the courts are required to keep records locally of any destruction.

Existing guardianships are only for minors, persons less than 18 years old. But legislation effective January 1, 2016 has created a new type of guardianship for unmarried persons 18 to 21 years old. The new law also authorizes extension of existing guardianships beyond the wards’ 18th birthday. The law specifies that these new and extended guardianships are in connection with the wards’ petitions for factual findings in California courts in support of their applications for Special Immigrant Juvenile Status (SIJS) with the United States Citizenship and Immigration Services, part of the federal Department of Homeland Security. Special Immigration Juvenile Status entitles the successful applicant to apply for permanent residence in the United States—a “green card,” and eventually to apply for citizenship.

The Probate and Mental Health Advisory Committee recommends revisions to Judicial Council forms to make them consistent with legislation enacted in 2015 and effective January 1, 2016 that changed the legal standard for a determination of a conservatee’s capacity to vote. Three Judicial Council forms that refer to the old standard must be revised to conform to the legislation. Another form inquires about a proposed conservatee’s capacity to vote, using the old standard. That inquiry is inappropriate for that form and should be deleted from the form in its entirety.

The Judicial Council has revised, effective January 15, 2016, the Order Appointing Probate Conservator (form GC-340) to reflect the new standard for disqualification of a conservatee from voting made by Senate Bill 589 in the 2015 Legislature, a law that became effective on January 1, 2016.  This revision joins the council’s December 2015 revision of four other conservatorship forms on this ground made effective on January 1, 2016. This Invitation to Comment has also been revised to include the revised form GC-340 with the other revised forms. The comment period on this proposal will end on January 22, 2016.

The California Supreme Court Committee on Judicial Ethics Opinions invites comment on two draft judicial ethics advisory opinions.  One draft opinion answers questions posed to the committee about the disqualification requirements for judges who have received aggregated or law firm campaign contributions that exceed $1,500 (CJEO 2013-004).  The second draft opinion discusses how judges can ensure that disclosures are made on the record when there is no court reporter or electronic recording of the proceedings (CJEO 2013-003).  Both draft opinions provide guidance under the California Code of Judicial Ethics, which establishes standards for ethical conduct for state judges on and off the bench and for candidates for judicial office.

Cantil-Sakauye in March 2011 to conduct an in-depth review of the AOC with a view toward promoting transparency, accountability, and efficiency.The Chief Justice received the report and recommendations on May 25. At its meeting on June 21, 2012, the Judicial Council accepted the report and directed that it be posted for public comment for 30 days. Comments received will be considered public and posted by name and organization under the Comments Received link below. The Judicial Council is the policy-making body for the judicial branch. References to specific cases, and judges, attorneys, parties, and others involved in a specific case may be redacted from posted comments on the SEC report.
