Change is Coming - September 1, 2018

On September 1, 2018, new laws go into effect that impact the Name Change and Gender Change processes.  

If you plan to file after September 1, 2018, you will need to follow the new process and use the new and updated forms.

Name Change (no gender recognition)

A person under the jurisdiction of the Department of Corrections and Rehabilitation or sentenced to county jail has the right to petition the court to obtain a name change. This person must serve the petition on a government agency.

Name Change to Conform to Gender Identity

The court shall grant the petition without a hearing unless a timely, good cause objection is filed.

ADULT: Name Change with Recognition of Gender Change and New Birth Certificate

Gender may be recognized as male, female, or nonbinary.

MINOR: Name Change with Recognition of Minor’s Gender Change and New Birth Certificate

Gender may be recognized as male, female, or nonbinary.

If there is a living parent who does not sign the petition, that parent must be served notice and an order to show cause directing them to appear at the hearing and to submit any objections in writing.
