e-Submissions Instructions (Fifth Appellate District)

NOTICE:
The Fifth District Court of Appeal DOES NOT accept ANY sealed documents electronically.

Sealed documents MUST BE in paper form in a sealed envelope in conformance with California Rules of Court, rule 8.46
.

Documents must be:

  • A single PDF file.
  • Unlocked (i.e., no passwords or saving as a PDF/A)
  • No more than 25 MB in size
  • An exact duplicate of the paper copy.

Working with PDFs


Naming the PDF File

The Court's naming convention requires you to include the case number and abbreviate the document title and filing party's Last Name, as indicated below. Use an underscore _ to separate the elements within the PDF file name. Do not use spaces, dashes or hyphens.

Example: Litigant John Doe will be submitting a copy of an Appellant's Opening Brief. The PDF file name should be as follows:

F012345_AOB_Doe.pdf

Example: A business entity will be submitting a copy of a Petition for Writ of Mandate. The PDF file name should be as follows:

F012345_PTW_StateFarmIns.pdf

In lieu of original and four paper copies, a party submitting an electronic copy of a "brief" is required to file an original and three paper copies.

A party who files a petition, answer, opposition, reply, or other response to a petition, including any supporting documents, must file an original and:

  1. one paper copy that is unbound, printed on white paper and does not contain tabs or a red cover; or
  2. an electronic copy in pdf. format, submitted through this page.

This is in lieu of the requirements contained in California Rules of Court, rule 8.44(b)(3) and (5). (Cal. Rules of Court, Local Rule 3)
