Traffic Tickets/Infractions Amnesty Program

On June 24, 2015, the Governor signed into law a one-time amnesty program for unpaid traffic and non-traffic infraction tickets. Here are some important details:

Traffic/Infraction Amnesty Program
Vehicle Code section 42008.8, enacted by Senate Bill 85, establishes a one-time amnesty program for an 18-month period, effective October 1, 2015 to March 31, 2017. All adult and juvenile traffic and non-traffic infraction tickets (except parking tickets, DUIs and reckless driving) where a delinquent fine or bail was due on or before January 1, 2013, may be eligible for the amnesty program.

Unpaid tickets may be eligible for a 50 or 80 percent discount under the one-time amnesty program, as long as a participant agrees to pay off the reduced amount or sign up for a payment plan.  Courts and counties—whichever is administering the program—are permitted to collect a $50 administrative fee to offset program costs.

All adult and juvenile infraction violations may be eligible for the amnesty program if:

  • The initial due date for payment of the fine or bail was on or before January 1, 2013.
  • An individual either failed to appear in court or failed to pay in full.
  • An individual is currently not making payments to a collection program under Penal Code section 1463.007(c).
  • An individual does not owe restitution to a victim on any case within the county where the violation was filed. However, an individual may participate once restitution is paid in full.
  • An individual does not have outstanding misdemeanor or felony warrants within the county where the violation was filed, other than warrants associated with the underlying infractions.

If driving privileges have been suspended due to unpaid debt, a driver’s license may be reinstated by the DMV once eligibility is determined and criteria have been satisfied.
