Electronic Devices for use at Oral Argument

Attorneys and self-represented parties may bring an electronic device for use at oral argument. An electronic device is defined as a laptop or tablet computer. Electronic devices do not include a cellular or smart phone. No audio or video recordings or taking of pictures are allowed at any time in the courtroom. An application must be submitted to the Court at least twenty four (24) hours prior to the scheduled oral argument. The completed Application and Terms/Conditions can be emailed to 5DCCourt@jud.ca.gov, faxed to 559-445-5769 or delivered to the Clerk's Office.

Oral Argument by Teleconference

The Fifth Appellate District has a teleconference system that enables attorneys or pro per litigants to present oral arguments by telephone as an alternative to a personal appearance in court. All oral arguments by teleconference will be heard by the Justices on the bench in the courtroom, which is open to the public.

There is a charge for the teleconference appearance of $20.00 for each attorney or pro per litigant making oral arguments in a civil appeal. A check shall be made payable to the "State of California" and is to be tendered upon receiving the Court's billing letter. There is no charge for court-appointed counsel in any case, the Attorney General or counsel representing a state, county or other government agency.

The Deputy Clerks will call the participants at least one hour before oral argument to make sure that they are going to be available for the teleconference at the pre-scheduled time. A second call is then made to the participants approximately five minutes before the start of the argument session so that they can be connected and waiting for the Justices to take the bench. The participants will be connected to the live oral argument session at the time their case is called.
