The Sixth District Court of Appeal has made the following adjustments for the health of the public and its employees in light of the COVID-19 health emergency, and in cooperation with the orders of Governor Newsom issued March 27, 2020, and updated on May 7, 2020, and of the Director of the Santa Clara County Department of Public Health issued May 18, 2020.

In compliance with the orders of Governor Newsom and the Santa Clara County Public Health Director, all persons coming to the Sixth District Court of Appeal are required to wear a face covering, maintain at least 6 feet of social distance from others not in their household, and observe rules of hygiene established in the order.  If you are sick or have symptoms of COVID-19, you should not come to the Sixth District Court of Appeal.

Pursuant to Misc. Order 20-002 oral argument sessions in the Sixth District Court of Appeal are being conducted telephonically.  Court proceedings will be open to the public and members of the press telephonically.  Instructions for participating in telephonic oral argument can be found here.

The Clerk's Office window is currently closed. However, court operations are functional. The court continues to receive phone calls, correspondence by email and U.S. Mail, and electronic filings. If you are unable to file your papers electronically, you may drop off paper filings, including emergency writs, in the drop box located on the 10th floor at 333 West Santa Clara Street, San Jose, California, next to the Sixth District Court of Appeal Clerk's Office entrance. If you need to review a document filed in this court, please contact the Clerk's Office via phone at 408-277-1004 or email at Sixth.District@jud.ca.gov to make an appointment.

Any further updates will be communicated through the court's website as appropriate.

It is with deep sadness that we report that Justice Eugene Premo passed away on January 25, 2021. He had suffered from declining health in the last weeks and retired on January 15, 2021.

Justice Premo was an institution.  He attended Bellarmine College Prep, received his Bachelor of Arts from University of Santa Clara, and his Juris Doctor from its law school after a stint in the United States Army - a diehard "double Bronco." Governor Ronald Reagan appointed him to the Santa Clara County Municipal Court in 1969, and the Superior Court in 1974. He served as a trial court judge for a full career of 20 years, and when many of his peers retired, Governor Deukmejian appointed him to the 6th District Court of Appeal in 1988 where he sat with distinction for 32 years.

He was a rarity, a jurist with over 50 years of service, a stalwart member of our Court who, in his very direct voice, contributed many outstanding opinions that shaped the law. He was a man of great kindness and decency, as well as a shrewd judge of character. Those five decades of judging provided him with the view from 30,000 feet, and we benefitted from that perspective, offered with his characteristic brevity and dry humor.

Justice Premo’s absence leaves a deep impression on the Court. The Justices of the 6th District Court of Appeal offer our condolences and sympathy to the Premo family, and the Court family mourns the loss of our longtime leader, colleague, and friend.

Sixth Appellate District Announces
Destruction of Old Court Records

The Court of Appeal, Sixth Appellate District has announced its intention to destroy the following civil records pursuant to California Rules of Court, rule 10.1028(d).

  • All civil cases (excluding those with published opinions) designated in records transfer list 119, 120, 126, 128, 129, 137 and 144 encompassing civil cases preserved for a period longer than 10 years.

The records transfer lists with case numbers and captions are file numbers: 119, 120, 126, 128, 129, 137, and 144.

Anyone who knows of a reason why any of the above cases should be retained, whether for historical or other reasons, should notify Baltazar Vazquez, Assistant Clerk/Executive Officer.  The reasons for retention should be in writing by February 22, 2021 to:

The Sixth District Court of Appeal has adopted Local Rule 4, which sets forth additional requirements for filing a civil case information statement in this District. Pursuant to rule 10.1030, the rule was printed in Advance Pamphlet No. 29, dated November 12, 2020 and will become effective on December 28, 2020.
